3. Client Terms

3.1 Engagement

When you engage Irving Scott to find household staff, you agree to:

• Provide accurate and complete information about your requirements
• Respond promptly to candidate presentations and communications
• Conduct interviews in a professional and respectful manner
• Comply with all applicable employment laws and regulations

3.2 Fees

Our placement fees are based on the annual salary of the placed candidate, typically ranging from 15-25%. Specific fee structures will be outlined in your service agreement. Fees are due upon successful placement or as otherwise agreed in writing.

3.3 Guarantee Period

We offer a replacement guarantee for placements that don't work out during the agreed probationary period, subject to the terms outlined in your service agreement.

4. Candidate Terms

4.1 Registration

When you register with Irving Scott as a candidate, you agree to:

• Provide truthful, accurate, and complete information
• Maintain the accuracy of your information
• Notify us immediately of any changes to your circumstances
• Not misrepresent your qualifications, experience, or references

4.2 Candidate Obligations

You agree to:

• Attend interviews scheduled on your behalf
• Notify us immediately if you accept employment elsewhere
• Not approach our clients directly for future positions
• Maintain confidentiality regarding client information

4.3 Candidate Fees

Irving Scott does not charge fees to candidates for job placement services.

5. Confidentiality

Both clients and candidates agree to maintain strict confidentiality regarding:

• Personal information shared during the recruitment process
• Details about households, families, and their staff requirements
• Compensation packages and employment terms
• Any other information marked as confidential

6. Employment Relationship

Irving Scott acts solely as a recruitment agency. We are not the employer of any placed staff. The employment relationship exists directly between the client and the hired staff member. Clients are responsible for all employment obligations including but not limited to:

• Employment contracts and agreements
• Wages, benefits, and working conditions
• Tax withholding and reporting
• Insurance and liability coverage
• Compliance with employment laws

7. Background Checks and References

While we conduct thorough screening of candidates including reference checks and DBS checks where applicable, clients are ultimately responsible for:

• Conducting their own due diligence
• Verifying qualifications and experience
• Making final hiring decisions
• Ongoing supervision and management of staff

8. Limitation of Liability

To the fullest extent permitted by law, Irving Scott shall not be liable for:

• Actions or omissions of placed staff members
• Employment disputes between clients and staff
• Any indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities

Our total liability under these Terms shall not exceed the fees paid by the client for the specific placement in question.

9. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Irving Scott and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Termination

We reserve the right to terminate or suspend access to our services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
